Ron Paul supporter under attack...Action Item

Nannette who painted her whole house Ron Paul.. in the sleepy little town of Magnolia has received a notice from her Mortgage company, not the Home Owners Association but the actual mortgage company. Her house will be foreclosed on if she does not have her house repainted by March 17th. It seems the Mortgage company does not like the paint colors? This is a beautiful paint job, well done and artistic.. It is really a work of art not a eyesore. I don't have any idea if the Company can really Foreclose within just 2 weeks or not but just the threat is enough to cause a lot of worry, especially when your mortgage payments are up to date. I would hope all of you would make a call today or Monday to this company and let them know you know of their actions. Just think of the problems it could cause them to have all their customers learn how their own mortgages could be called in if they offended the powers that be? As you know if your house is apart of an association she has to abide by the rules, and this is breaking the rules of most associations. I don't think they are picking on her because it's Ron Paul.
The association will pick on anyone if the houses don't conform to the rules which is most of the time you cannot paint your house loud colors or any color without approval of the association. I don't think they can foreclose on her, I never heard of anything like that BUT I'm sure they (the association) can fine her with legal action for her to conform to the rules she agreed to abide by when she purchased. I suggest to call the Department of Real Estate of her state to check into this and contact a Real Estate Attorney. This came from the mortgage co, not the homeowners association,is that correct ?
In that case it is just discrimination as the homeowners association did not file a complaint with her directly. Seems like the Association would make the first contact if this is a rules issue. Are they connected or is the mortgage carried privately? Interesting. Definitely lawyer up. |

The mortgage company is out of step here.
I just spoke with another agent friend of mine, he said the same, he doesn't think they can foreclose on her either, again she needs an attorney. Edited by Tracey on Mar 2, 2008 12:13 AM |

Yeah...from what I read elsewhere ,this has nothing to do with the home owners association. It's the Mortgage company for cryin' out loud.

One of the obligation clauses in your mortgage states that you will maintain the property properly and that you will not do anything that we cause a deprecation in the property value.

I don't see how paint - a temporary fixture - could cause depreciation of value. A serious lack of paint or run down appearance maybe. But this is art.

That is your opinion. Obviously the mortgage company has another. Guess who wins since they have a financial stage it.
